Stakeholder Ramifications of New Hospital Transparency Tools and Reporting Requirements of the Conciliated Appropriations Act. A Fiduciary Concern for Employers?

Description
The first part of the program will describe new hospital transparency tools that are available nationally to all healthcare stakeholders. These include the RAND 4.0 Hospital Price Transparency Project, the National Academy for State Health Policy Hospital Cost Tool, and the Hospital Value Dashboard. The first portion of the program will provide an overview of these tools, how to access them, and how they can be used by employers, health plans, hospitals, and policy makers. The second part of the program will present the legal reporting requirements of hospitals, health plans and plan sponsors under the Consolidate Appropriations Act of 2021. Emphasis will be placed on plan sponsor responsibilities: Removal of gag clauses from service provider contracts on price and quality information; Review of broker compensation and service disclosures; Determination of broker compensation reasonableness; and Prescription drug disclosures. The requirements of hospitals and health plans will also be addressed. It will include a summary of hospital compliance for positing the discounted cash price; the minimum negotiated charge; and the physician fees. The final part of the program will address the fiduciary exposure for plan sponsors in light of the new tools and the CAA requirements. Specifically, the similarity and transferability of the argument of healthcare benefits management to the ERISA litigation resulting from 401k benefits mismanagement will be explored.
